Terms of service

Crane Parts Inventory. Effective [effective date].

1. Who these terms are between

These terms are between [Registered company name], company number [Company number], registered office [Registered office address] ("we", "us"), and the company that signs up for Crane Parts Inventory ("the customer"). The people the customer invites ("users") use the service on the customer's behalf and must follow these terms too.

By creating an account or using the service, the customer accepts these terms. If you accept them for a company, you confirm you are authorised to do so.

2. The service

Crane Parts Inventory is an online system for managing crane parts, fleet records, maintenance, inspections, suppliers and lifting equipment. We may improve and change the service. If we remove something the customer relies on, we will give reasonable notice.

3. Accounts and access

  • The customer's administrators decide who is invited and what each user can do. The customer is responsible for its users and for removing access when someone leaves.
  • Users must keep their sign-in details to themselves and tell us at [support contact email] if they think an account has been misused.
  • We may suspend an account to protect the service, the customer or others, and will tell the customer why unless the law prevents us.

4. Acceptable use

The customer and its users must not:

  • try to reach another company's data, or get around the service's security or access limits;
  • upload anything unlawful, or anything they have no right to upload;
  • disrupt the service, overload it, or copy it by automated means;
  • resell or provide the service to others without our written agreement.

5. The customer's data

Everything the customer puts into the service remains the customer's. The customer gives us permission to host, process and back up it only to provide the service. Where it includes personal data, we process that as the customer's processor, as set out in our privacy notice. The customer is responsible for having the right to put that data into the service and for the accuracy of what it enters.

The customer can ask us for a copy of its records at any time, and can delete its account. After deletion we remove its data as the privacy notice describes.

6. Manufacturer documents, maintenance rules and inspection records

The service can suggest maintenance intervals, inspection items and part information drawn from manufacturer documentation, suppliers and other sources. These suggestions help the customer; they do not replace the manufacturer's instructions, the law, or the judgement of competent persons. The customer remains responsible for how its cranes and lifting equipment are maintained, examined and used, and for checking any suggestion before relying on it.

Records made in the service, such as inspections, examinations and sign-offs, are the customer's records. The customer is responsible for making sure they meet the legal requirements that apply to it, including LOLER and PUWER where relevant.

7. Fees

Fees, if any, and how they are paid are agreed with the customer separately. Unless agreed otherwise, fees are payable in advance and are not refundable for part periods.

8. Availability and support

We aim to keep the service available and to fix faults promptly, but we do not promise it will be uninterrupted or free of errors. Planned maintenance will be kept short and, where possible, announced in advance. Support requests go to [support contact email].

9. Our intellectual property

The service, its software and its design belong to us or our licensors. The customer receives a right to use the service for its own business during the subscription, and nothing more. Suggestions the customer makes to improve the service may be used by us freely.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Otherwise, we are not liable for loss of profit, revenue, business or goodwill, or for any indirect or consequential loss, and our total liability in any 12-month period is limited to the fees the customer paid us in that period.

11. Ending the agreement

The customer can stop using the service and delete its account at any time. We can end the agreement on 30 days' notice, or straight away if the customer seriously breaches these terms. On ending, the customer can ask us for a copy of its data within 30 days, after which we delete it.

12. Changes to these terms

We may update these terms. We will give at least 30 days' notice of material changes in the service or by email. Continuing to use the service after the change takes effect means accepting the new terms.

13. Law

These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.

14. Contact

Questions about these terms: [support contact email]. About personal data: [privacy contact email].
